Model Booking
Agreement
This is a simple agreement between the Model and you (the Client). By hiring a model, you agree to follow these terms. This agreement explains what the Model will do, what you will pay them, and what you can and cannot do with the photos and videos you create.
1. The Job Description
What You Must Do
- You will describe the exact job in writing when you book the Model. This must include where they need to be, what time they start and end, what the shoot is for, and what they will be modeling.
- If you want to make changes to the job, you must ask the Model first in writing. If they agree to changes, you may need to pay them extra.
- You cannot ask the Model to do anything NOT mentioned in the job description without paying them extra.
2. Your Payment Obligations
How Much You Must Pay
- You will pay the Model the amount you both agreed on for this booking.
- Payment must be made before the day of the shoot unless otherwise mutually agreed upon. Accepted methods: cash, bank transfer.
Late Payment Penalty
- If you don't pay the Model within 24 hours of the due date, you owe them an extra 2% per day on top of their fee for every day you are late.
What's Included in the Modeling Fee
- The modeling fee covers only the time the Model spends modeling.
- The modeling fee does NOT include makeup, hair, wardrobe, transportation, or meals.
Overtime Payment
- If the shoot goes over the scheduled time, you must pay the Model extra for overtime.
- Overtime pay is 1.5× the regular hourly rate for every 15 minutes over.
- Example: If you book the Model for 4 hours and the shoot runs 5 hours, you owe them 1 hour of overtime at 1.5× their rate.
- Overtime fees must be paid directly to the Model — in cash or bank transfer — before the overtime period begins.
- If the overtime fee has not been paid prior to the start of overtime, the Model has the right to leave the set immediately and is still owed full payment for all scheduled time worked.
3. Meals and Breaks
What You Must Provide
- 1–4 hours: One meal or meal break
- 4–6 hours: Food and water during breaks
- 6+ hours: Two meals or meal breaks
All meals must be reasonable and appropriate for the type of shoot.
Breaks
- The Model is entitled to a 15-minute break for every 4 hours of work.
- Breaks are unpaid but are built into the scheduled time.
4. What You Must Provide or Pay For
You must provide OR pay the Model extra for:
- Professional makeup artist or makeup services
- Hair styling or hair services
- Wardrobe (clothes and accessories)
- Transportation to and from the shoot location
- Parking fees (if applicable)
- Meals and beverages
- Hotel or accommodation (if needed for multi-day shoots)
If you want the Model to provide any of these, you must agree on and pay additional fees in writing beforehand.
5. How You Can Use the Photos and Videos
What You CAN Do
- Use the photos/videos only for the specific purpose you agreed to in writing (e.g. Instagram post, magazine cover, website, advertisement).
- Use them only for the length of time you agreed to (e.g. 1 year, 2 years, etc.).
- Use them only in the places you agreed to (e.g. social media only, print only, website only).
What You CANNOT Do
- Sell, lease, or give the Model's photos to another company without their permission.
- Use the photos after the agreed-upon time ends — you must stop using them.
- Change or edit the photos in ways that make the Model look bad or are misleading.
- Use the photos to endorse products or services the Model didn't agree to.
- Use the photos on your main website or portfolio without paying extra (portfolio use requires a separate agreement).
Portfolio Use
- If you want to use the Model's photos in your portfolio or for your marketing, this is a separate agreement and you must pay them extra or get their written agreement.
Model's Right to Refuse
- The Model can say "no" to any use that was not agreed on. You must stop using their photos immediately when they ask.
6. How to Confirm the Booking
What You Must Do
- Give the Model the job details in writing (email, text, or contract).
- Wait for the Model to confirm in writing that they accept the booking.
- The details must include: date, time, location, what they will be modeling, pay rate, and how the photos/videos will be used.
7. If You Cancel or Change Plans
If You Cancel
- More than 7 days before: No payment owed (unless you agreed differently)
- 3–7 days before: You must pay the Model 50% of their agreed-upon fee
- Less than 24 hours before: You must pay the Model 100% of their agreed-upon fee
- Day of the shoot: You must pay 100% of their fee plus all travel costs they already spent
If You Change the Time or Location
- You must ask the Model first. They can refuse changes.
- If your changes make the job harder for them (e.g. longer travel), you must pay them extra.
8. If the Model Can't Make It
If the Model Cancels
- More than 7 days before: You owe them nothing
- 3–7 days before: The Model owes you 25% of the agreed-upon fee
- Less than 24 hours before: The Model owes you 50% of the agreed-upon fee
- Day of the shoot: The Model owes you 100% of the agreed-upon fee
Exception: If the Model cancels due to illness or emergency, both parties can work out a fair solution.
9. Safety and Behavior on Set
You Must
- Treat the Model with respect and professionalism
- Provide a safe working environment
- Tell the Model upfront if the shoot involves nudity, partial nudity, or any sensitive content
- Never pressure the Model into anything they didn't agree to
- Provide a safe, private place for them to change clothes
The Model Must
- Arrive on time
- Be professional and do their best work
- Follow your reasonable directions and the photographer's directions
- Respect your equipment and property
10. Unselected Photos
- Any photos NOT selected or used by you become the Model's property to use for their portfolio.
- You should give the Model copies of all photos taken (selected and not selected), unless you agreed otherwise in writing.
- You cannot use photos the Model didn't agree to let you use, even if they were taken during the shoot.
11. Privacy and Confidentiality
What the Model Keeps Private
- If you share private business or project information, the Model keeps it confidential.
- The Model cannot post behind-the-scenes content without your permission.
What You Keep Private
- You keep the Model's contact information and personal details private.
- You cannot share their information with other people unless they agree.
12. Test Shoots vs. Paid Work
Test Shoots (TFP — Trade for Portfolio)
- If this is a free or reduced-pay shoot, this must be clearly agreed to in writing before the shoot.
- Both you and the Model get equal rights to use the photos for portfolio purposes.
- You must still provide meals and breaks as required by this agreement.
- Payment terms may be different, but this must be agreed to in writing.
13. Usage Fees
- Commercial advertising: If photos are used for commercial advertising, you must pay extra beyond the modeling fee. The amount must be decided before the shoot.
- Reuse: If you want to use photos for something different than originally agreed, you need the Model's permission and may need to pay extra.
- Exclusivity: If you want the photos to be exclusive (used only by you), you must pay extra.
14. Entire Agreement
- This agreement, plus the job description and booking confirmation, is the entire agreement between you and the Model.
- Any promises made that are NOT in writing do not count.
- If there is a disagreement about what was promised, the written agreement wins.
15. Changes to This Agreement
- You cannot change this agreement without asking the Model first and getting their approval in writing.
- If the Model doesn't agree with a change, they don't have to accept the booking.
16. Questions or Problems
- First, talk to the Model directly and try to work it out.
- If you cannot agree, you can ask a neutral third party to help.
- These terms are governed by the laws of the Federal Republic of Nigeria.
17. Independent Contractor Status
- The Model is not your employee.
- You do not provide benefits, taxes, or insurance.
- The Model is responsible for their own taxes.
- The Model is free to work with other Clients.
